1. About these terms
These terms govern your use of the Homecue website and the affordability check (the "service"). By using the service you agree to these terms. If you do not agree, please do not use the service. We may update these terms from time to time; the version in force is the one published here when you use the service.
2. Who we are, and what Homecue is
Homecue is a trading style of Cestrian Digital Ltd, registered in England and Wales (Company No. 14782311), registered office 1 Aldgate Tower, London E1 8FA.
Homecue is an introducer service. We are not a lender, and we are not authorised to give regulated mortgage advice. We do not recommend or arrange mortgage products. What we do is help you understand, in general terms, what you might be able to borrow, and, if you choose, introduce you to an FCA-authorised mortgage broker who can give you regulated advice.
3. Indicative figures, not advice
The affordability check uses general assumptions and the information you enter to produce illustrative figures, such as an indicative borrowing range, loan-to-value band, or potential costs. These are estimates to help you understand your situation. They do not take account of your full circumstances, are not personal to you in a regulated sense, and must not be relied on as advice or as a commitment to lend. Lenders apply their own criteria and stress tests, so your actual position may be higher or lower.
4. Using the service
The service is free to use. When you use it, you agree to:
- provide accurate information (the results are only as good as what you enter);
- use the service only for your own genuine, lawful purposes;
- not misuse the service, attempt to disrupt it, or access it by unauthorised means.
You do not need to create an account or pass a credit check to see your results, and you are under no obligation to be introduced to a broker.
5. Introductions to brokers
If you choose to be introduced to a mortgage broker from our panel, the following applies:
- we pass the details you have entered to the broker you select, and only to that broker, so they can contact you (see our Privacy Notice);
- the broker, not Homecue, is responsible for the regulated advice they provide and for the service they give you;
- Homecue receives a fee from the broker for the introduction. The service remains free to you, and Homecue does not charge you;
- choosing which broker to be introduced to, and whether to act on their advice, is your decision.
We carry out checks on the brokers on our panel, including that they are authorised by the FCA, but we do not guarantee their advice or the outcome of your dealings with them.
6. No reliance and our liability
The service is provided for general information and on an "as is" basis. To the fullest extent permitted by law, we are not liable for any loss arising from your reliance on the indicative figures, from a decision you make, or from the advice or services of a broker you are introduced to. Nothing in these terms limits or excludes our liability where it would be unlawful to do so, including for death or personal injury caused by our negligence, or for fraud. Subject to that, our total liability to you in connection with the service is limited to one hundred pounds (£100).
7. Intellectual property
The content, design, branding and software of the Homecue website belong to Cestrian Digital Ltd or its licensors. You may use the site for your own personal, non-commercial purposes. You may not copy, reproduce or reuse it for any other purpose without our permission.
8. Availability and changes
We aim to keep the service available but we do not guarantee it will be uninterrupted or error-free. We may change, suspend or withdraw all or part of the service, and we may update these terms, at any time.
9. Governing law and complaints
These terms, and any dispute arising from them or the service, are governed by the law of England and Wales, and subject to the exclusive jurisdiction of the courts of England and Wales.
If you have a complaint about Homecue, please contact complaints@homecue.co.uk and we will try to put things right. If your complaint concerns regulated advice given by a broker on our panel, please raise it with that broker in the first instance; eligible complainants may then be able to refer the matter to the Financial Ombudsman Service.
